Private judging is an efficient alternative to resolving your case in court. Ohio Revised Code Section 2701.10 provides for active litigation to be reassigned by agreement of the parties to a retired judge authorized by law to "have all the powers, duties, and authority of an active judge of the court in which the action is pending." O.R.C. 2701.10(C).
The process begins with a consultation at which time the judge will determine if the case is one that can or should be handled privately. An agreement is then reached and signed that specifies the following:
- the issues to be decided by the judge;
- the parties' responsibility to provide all facilities needed for the proceeding or whether the issues are suitable for remote proceedings;
- the agreed-upon compensation for the private judge.
Neutral evaluation is a dispute resolution choice that is more directive than mediation, but still allows you to make your own decisions about how to resolve the conflict. In this process, each side presents their case to a trained neutral professional. The evaluator will then weigh the strengths and weaknesses of each position and given the parties a non-binding reasoned assessment on the merits of the case. In this process, it is essential for the neutral evaluator to possess the training and expertise to make that evaluation helpful to the parties.
Arbitration is similar to private judging in that a trained, neutral professional renders a decision in the case. It happens when both sides have previously contracted to or now agree to submit the dispute to arbitration at any stage of the conflict, Arbitration can either be binding or non-binding based on the agreement of the parties.
